Terms of Service — Bird List

Last updated: October 29, 2026

Bird List is an app for keeping lists of the birds you observe and photograph, developed and offered by Eduardo Simioni, an individual developer based in Brazil (“the developer”). By installing or using the app you agree to these terms. If you do not agree, please do not use the app.

The app and your license

Bird List is free. It needs no account, shows no ads and keeps working without an internet connection. The developer grants you a personal, non-exclusive, non-transferable license to use the app on devices you own or control, under these terms and the rules of the store you got it from (Google Play or the App Store). You may not copy, modify, redistribute or sell the app, except where the law expressly allows it. Use it lawfully and in line with the terms of the services it connects to.

If you got the app from Apple's App Store, Apple's Licensed Application End User License Agreement also applies to you.

Your data

The records, photos, audio, notes and lists you create stay on your device and belong to you; the developer has no access to them (see the Privacy Policy). Keeping a copy is up to you: the app offers export and an optional backup to your own Google Drive. Without a copy, uninstalling the app or losing the device can mean losing your data.

You are responsible for having the right to use the photos, sounds and files you attach or import.

Third-party content and services

The app shows content from other sources: species names and taxonomy (eBird/Clements, CBRO, IOC World Bird List), reference photos and songs (iNaturalist, Wikimedia Commons, xeno-canto, WikiAves) and maps and place names (OpenStreetMap). That content belongs to its authors and is used under their licenses, with the credit shown in the app. These services are independent of the developer: they may change or stop at any time, and their own terms apply to them. Links to other apps and sites, such as eBird, Merlin and WikiAves, are there for convenience.

Identification and the records you share

Names, photos and songs are reference material and may contain errors. Identifying each bird is your call, and so is what you send to other platforms — such as the file you upload to eBird — which must follow their rules.

Voluntary contributions

Every feature of the app is free. Contributing to the developer is voluntary and unlocks nothing. On iPhone, a contribution is an in-app purchase processed by Apple, and refunds follow Apple's rules. Contributions by Pix or Ko-fi go directly to the developer; for any question about one, write to the address below.

No warranty

The app is provided “as is” and “as available”. To the extent permitted by law, the developer does not warrant that it will work without errors or interruptions, or that third-party content is accurate or available.

Limitation of liability

To the extent permitted by law, the developer is not liable for indirect or consequential damages, or for loss of data, arising from the use of the app or from being unable to use it. Nothing in these terms excludes or limits a liability that the law does not allow to be excluded or limited, nor the rights you have as a consumer under the mandatory laws of the country where you live.

Changes

The developer may update the app, change or remove features, or stop offering it. These terms may change too; changes will be shown by updating the date above. You can stop using the app at any time by uninstalling it — export your data first.

Governing law

These terms are governed by the laws of Brazil. If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, nor your right to go to its courts.
